Vi kan opplyse om at vår advokat mandag oversendte et kort prosesskriv til Tingretten i anledning REC Silicons uttalelse til vår begjæring om granskning.

Bakgrunnen for tilsvaret er at vi mener selskapet i sin redegjørelse gir et uriktig og misvisende bilde både av oss som begjærere og av de faktiske forhold saken gjelder. Videre fant vi det nødvendig å kommentere enkelte nye opplysninger og vurderinger som fremkommer i REC Silicons uttalelse. Etter vårt syn bidrar disse opplysningene til å styrke grunnlaget for vår granskingsbegjæring, og de underbygger også vår anførsel om at det er saklige grunner til å gjennomføre granskning slik generalforsamlingen har besluttet.

Vi håper på en avgjørelse så snart som mulig, men det er Tingretten som bestemmer fremdriften.

We can inform you that on Monday, our lawyer sent a short procedural document to the District Court in connection with REC Silicon’s statement to our request for an investigation.

The background for the response is that we believe that the company’s statement gives an incorrect and misleading picture both of us as petitioners and of the facts of the case. Furthermore, we found it necessary to comment on certain new information and assessments that appear in REC Silicon’s statement. In our view, this information helps to strengthen the basis for our request for an investigation, and it also supports our argument that there are objective reasons to conduct an investigation as decided by the general meeting.

We hope for a decision as soon as possible, but it is the District Court that decides the progress.
